Security contract for guarding monument of cultural heritage

A guarding agreement is a mode of use of a cultural heritage monument (hereinafter - a memorial) or a part of one, including the territory in which it is located. The owner of a monument or a part of it, or an authorized body (person) thereof, must, not later than one month after the receipt of the monument or part of it in ownership or use, conclude a guarding agreement with the relevant guardian of the cultural heritage.
The guard contract specifies the features of the mode of use of the monument, the types and timing of restoration, conservation, repair, works on the arrangement of its territory, other measures, the need for which is decided by the relevant body of protection of cultural heritage.

What is the regulated conclusion of a guarding agreement?

With which authority is it necessary to conclude a security contract (Kyiv)?

The Department of Cultural Heritage Protection (executive body under Kyiv City State Administration)
If the monument belongs to the category of monuments of national significance, the guarding agreement is signed by the guardian of the cultural heritage on whose territory the monument is located, after it has been agreed with the central executive body in the field of cultural heritage protection.
For monuments of national significance, which belong to the sphere of management of any central executive body, a guarding agreement is concluded with the central executive body in the field of cultural heritage protection.

Documents necessary for the conclusion of a security contract:

  • letter of appeal to the head of the Department of Cultural Heritage Protection (original)
  • statement of the owner (user) of the premises (original)
  • coordination of state bodies for the protection of monuments to the alienation of the monument (original)
  • a certificate of title (or contract of sale) or a lease agreement for the monument (a copy certified by a notary public or a seal of the corresponding state institution that issued the document)
  • certificate of ownership of other premises of monuments (in case of availability - security contracts for these premises) (a copy certified by a notary public or a seal of the corresponding state institution that issued the document)
  • floor plans of the premises (KM BTI plans with explication made in the current year, which are in accordance with existing planning) (a copy certified by a notary public or stamp of the corresponding state institution that issued the document)
  • design documentation for carrying out repair works on the premises and on the facades of the monument corresponding to these premises, approved in accordance with the established procedure (in case of repair of monument)
